The Department of Justice states that "Consumers who live in states permitting the option to choose innovative brokerage options, such as rebates or fee-for-service MLS-only packages, can potentially save thousands of dollars on commission payments."
Are Rebates Legal?
Addressing the question of legality, it's essential to clarify that real estate buyer rebates are well within the bounds of the law in the picturesque state of Florida, as well as in 40 other states across the nation. At GPM Realty Services, we proudly offer a new home rebate program that aligns with the legal landscape, providing you with a unique opportunity to maximize your investment without any hidden costs or obligations.

Step 1 Contacting GPM Realty Services with your Florida dream home/community. We will contact your chosen communities and make the arrangements for your first visit.
Step 2 Make your first visit to the communities that GPM Realty Services has arranged for you. At that time, have the GPM Realty Service registration form completed and faxed or e-mailed back to GPM Realty Services. Once the registration form is received and verified, GPM Realty Services becomes the procuring broker of record at the communities you visit. Some new home communities have a policy where a time limit is set from the first visit date to the contract date, normally 3-6 months, and if exceeded will cancel the broker of record. Verify with each community you visit their policy on the broker of record time limit.
Step 3 The most critical is your purchase of a new construction home from the builders/developers you have visited, where GPM Realty Services is the recorded broker of record. When you close on the home you purchased, GPM Realty Services will pay a buyer rebate to you of 50% of the sales commission paid to GPM Realty Service as a credit to you recorded on the closing HUD settlement statement.
Rules for a Real Estate sale commission rebate in Florida
In Florida, real estate commission rebates are allowed under certain conditions, and there are specific rules and regulations that govern this practice. Here are the key rules for a real estate sale commission rebate in Florida:
Licensed Real Estate Professionals: Only licensed real estate brokers and sales associates are legally permitted to offer commission rebates to their clients.
Written Agreement: The commission rebate must be documented in a written agreement between the real estate professional and their client. The agreement should clearly outline the terms and conditions of the rebate.
Disclosure of Rebate: The real estate professional must disclose the commission rebate to all parties involved in the transaction, including the buyer and the seller.
Non-Discrimination: The commission rebate must be offered to all clients equally and without discrimination based on factors such as race, color, religion, sex, national origin, disability, or familial status.
Compliance with State and Federal Laws: The commission rebate must comply with all applicable state and federal laws, including those related to fair housing and anti-discrimination.
Transparency: The real estate professional must be transparent about the amount of the rebate and any conditions or requirements for receiving the rebate.
No Influence on Transaction: The commission rebate should not influence the terms or conditions of the real estate transaction or interfere with the fiduciary duties of the real estate professional.
No Referral Fees for Unlicensed Individuals: Unlicensed individuals, such as friends or family members, cannot receive referral fees for referring clients to a licensed real estate professional offering commission rebates.
Escrow Disputes: In case of disputes over the commission rebate, the rebate amount can be placed into an escrow account until the dispute is resolved.
Compliance with Brokerage Policies: If the real estate professional is affiliated with a brokerage, they must comply with the brokerage's policies and guidelines regarding commission rebates.
Full Compliance with FREC Rules: The commission rebate must adhere to all rules and regulations set forth by the Florida Real Estate Commission (FREC).
Adhering to these rules ensures that the commission rebate process is conducted ethically and in accordance with Florida real estate laws. It's essential for both real estate professionals and clients to be aware of these rules to avoid any potential legal issues and to have a clear understanding of their rights and responsibilities in a commission rebate transaction.
Federal rules for real estate sale commission rebates apply nationwide and are governed by the Department of Housing and Urban Development (HUD) under the Real Estate Settlement Procedures Act (RESPA).
The key federal rules for a real estate sale commission rebate in Florida (and other states) are as follows:
Disclosure: The real estate professional must fully disclose the commission rebate to the buyer in writing, clearly explaining the amount or percentage of the rebate and any terms or conditions associated with it.
No Kickbacks: Commission rebates should not be provided in exchange for any referrals or business between settlement service providers. This means that the rebate should be solely based on the real estate transaction and not tied to other services or business arrangements.
No Influence on Referral: The commission rebate should not be used to influence the buyer's selection of a particular lender, title company, or other settlement service provider.
Fair and Non-Discriminatory: The commission rebate must be offered to all buyers equally and without discrimination based on race, color, religion, sex, national origin, disability, or familial status, as required by fair housing laws.
RESPA Compliance: All commission rebate practices must comply with RESPA guidelines to avoid any violations or penalties.
Escrow Disputes: In the event of any disputes regarding the commission rebate, the rebate amount can be held in escrow until the dispute is resolved.
State Law Compliance: In addition to federal rules, the commission rebate must also comply with any applicable state laws and regulations in Florida.
It's crucial for real estate professionals and buyers to be aware of these federal rules to ensure that commission rebate transactions are conducted legally and ethically. By following these rules, both parties can benefit from the savings offered by commission rebates while ensuring compliance with RESPA and fair housing regulations.
RESPA (Real Estate Settlement Procedures Act) guidelines for a real estate sale commission rebate in Florida (and other states) include the following:
Full Disclosure: The real estate professional must disclose the commission rebate in writing to the buyer. The disclosure should clearly state the amount or percentage of the rebate and any terms or conditions associated with it.
No Requirement: The buyer cannot be required to use a specific real estate broker or agent to receive the commission rebate. The rebate should be offered as an option, and the buyer is free to choose their preferred agent.
No Influence on Referral: The commission rebate should not be provided in exchange for referring business to a specific lender, title company, or other settlement service provider. The rebate must be based solely on the real estate transaction.
Fair and Non-Discriminatory: The commission rebate should be offered to all buyers equally and without discrimination based on race, color, religion, sex, national origin, disability, or familial status, in compliance with fair housing laws.
No Increase in Costs: The commission rebate should not result in an increase in other settlement costs or fees paid by the buyer. The rebate should be a genuine reduction in the agent's commission.
Escrow Disputes: In the event of any disputes regarding the commission rebate, the rebate amount can be held in escrow until the dispute is resolved.
RESPA Compliance: All commission rebate practices must comply with RESPA guidelines to avoid any violations or penalties. Real estate professionals and buyers in Florida must adhere to these RESPA guidelines when offering or receiving a commission rebate to ensure compliance with federal law and promote fair and transparent real estate transactions. It is important to note that the US Department of Justice enforces the Real Estate Settlement Procedures Act (RESPA) and ensures compliance with its guidelines related to real estate transactions, including commission rebates.
